Terms & Conditions of use policy

General
These terms shall be governed by and interpreted in accordance with the laws of Czech Republic. If any of these terms are determined to be illegal, invalid or otherwise unenforceable by reason of the laws of any state or country in which these terms are intended to be effective, then to the extent and within the jurisdiction in which that term is illegal, invalid or unenforceable, it shall be severed and deleted from these terms and the remaining terms shall survive, remain in full force and effect and continue to be binding and enforceable.

Access to and use of RipSpy and its services is provided by RipTech s.r.o. subject to the following terms.

By using RipSpy app you agree to be legally bound by these terms which shall take effect immediately when you first use RipSpy. If you do not agree to be legally bound by all the following terms, please do not use RipSpy.

RipTech s.r.o. may change these terms at any time by posting changes online. Please review these terms regularly to ensure you are aware of any changes made by RipTech. Your continued use of RipSpy after changes are posted means that you agree to be legally bound by these terms as updated and / or amended.

There are no hidden charges or catches and you can cancel your repeat payments at any time for any reason.
About us
We are a private limited company RipTech s.r.o. registered in Czech Republic with company number 08063737. Our registered office is K louži 785/4, Vršovice, 101 00 Praha 10. RipTech s.r.o. is the controller and responsible entity (herein and after referred to as "RipTech", "RipTech s.r.o." "we" or "us").

RipTech provide real time surf reports via an app called RipSpy. Our services include a free registration and a payed one called Pro account.

We are bound by applicable data protection laws in respect of the handling and collection of your personal data. If you have any questions about our privacy policy, including any requests to exercise your legal rights, please do not hesitate to contact us.
Pro acount
After a registration you gain access to a Pro account for 72 hours for free. In case you invite three friends which buy a Pro account, you gain one month of Pro account access for free.

You can also register as a Reporter and upload videos to RipSpy. If you upload at least 25 reports (videos) per month, you gain one month of Pro account access for free. However, you can upload maximum of 3 videos of one surf spot daily.

A monthly subscription to our RipSpy Pro app providing Full HD reports, costs 9.95€. Our free version provides you the same services except for Full HD videos, which are blurred.

If you are uploading video to RipSpy app and meanwhile you close the app, the video can still be uploading even after the closure.
Basic account
While using our basic account, you are not charged for any monthly or annual period unless you subscribe for a Pro account.

We reserve the right to limit free 72 hours long Pro account preceding a basic account availability to one trial per customer.

USE OF RIPSPY APP

General
You may not copy, reproduce, republish, download, post, broadcast, retransmit, make available to the public, or otherwise use RipSpy app content in any way except for your own personal use. Any other use of RipSpy app content requires the prior written permission of RipTech s.r.o.

You agree to use RipSpy app only for lawful purposes, and in a way that does not infringe the rights of, restrict or inhibit anyone else's use and enjoyment of RipSpy app.

We store data into your mobile device, and we cache your settings and all the videos.

If you are uploading video to RipSpy app and meanwhile you close the app, the video can still be uploading even after the closure.
Disclaimers and Limitation of liability
Under no circumstances will RipTech be liable for any losses, damage or injury arising from any use of RipSpy Pro or from decisions made based on the information provided by RipSpy Pro.

While RipTech will strive to provide the best service possible we cannot guarantee that RipSpy Pro will be available at any given time or that it will be free from errors.

You explicitly acknowledge that RipSpy app may use up a lot of mobile data. The decision whether to use the app despite this fact is your responsibility, as we cannot impact the data usage.

We are not liable for missing or wrong content. The money paid for a Pro account cannot and will not be returned for this reason.
Intellectual Property
The RipSpy name, images and logos identifying RipSpy and associated products and services are subject to copyright, design rights or trademarks owned by RipTech. The content of our app is also copyright of RipTech. No intellectual property of RipTech can be used without the explicit written consent of RipTech.

COOKIE POLICY

What is a cookie
A cookie is a tiny amount of information that our application store on your computer or mobile device. It is very important to understand that this application doesn't allow us to access information on your computer or mobile device (other than very standard settings like your language and time zone). So, we can only store in a cookie information that we already have about you. However, what we can use the cookie to identify that the reports today is the same one you used yesterday. This is vital for almost any application. Without this cookie you'll need to give us the same information every time you visit RipSpy.

So, cookies are essential for our needs (and almost all websites and applications to work properly) but you've always had the option to disable them. Of course, in doing this we can't 'remember' the information you give us so our application stops working as you'd expect. But that's entirely your choice.
Purpose and use of cookies
Anywhere there is a setting you can choose and needs to be remembered:

• Your Continent, Country, Region and Spot choices.
• Your Units choice for the forecast.
• Your configuration for the directory map display.
• Whether you choose the old forecast display or the new beta version.

If you register for a user account with RipSpy, we must use a cookie to allow us to understand that your mobile device or computer is logged into that account (otherwise you'd need to enter your username and password every time). This also allows us to identify that the request for an entrance is coming from 'you' and tie that information together with other information you explicitly give us. While this legal directive doesn't ask us to talk about what we store in our database about you it's information like your email address, your chosen username and any content you upload (photos, videos, forum posts).

Again, do remember that none of this information is available to us through any mechanism other than you providing it for us. We use no other sources for gathering information about you than those you provide.

We use a cookie provided by google analytics to recognise that your device is requesting pages from our application. This allows us to identify patterns of usage for the application.
Again, this cookie doesn't allow us to identify you personally or any personal information about you for our analysis. This just allows us to improve our application and provide common statistics that our advertisers and sponsors need, not about you, but about overall usage of the application. For example we cannot tell that our average user is 18-35, college educated and drives an estate car but we can tell the average user of our application views about 5.7 pages each time they come to the website and visits 2-3 times a day. It's important to reiterate that we use general information about how many people visit our website as part of selling advertising, but we don‘t offer or operate any scheme to target advertising to specific information that's stored about you personally other than the country from which you visit, for which we don't need to use cookies but we add here to ensure this document is as thorough as possible.

To display advertising banners, we use these statistics and analytics to ensure that our advertising is being delivered properly. For example, we may use a cookie to ensure that you see an advertising banner only a certain number of times for a specific advertiser.

PRIVACY POLICY

General
RipSpy respects your privacy and is committed to protecting your personal data. This privacy policy will inform you as to how we look after your personal data when you visit our RipSpy mobile app via IOS or Android, when you subscribe to use our services or when you otherwise contact us. It will also tell you about your privacy rights and how the law protects you.

This privacy policy is provided in a layered format so you can click through to specific areas and navigate quickly and easily.

References to "you" or "your" are to you as an individual using our application or otherwise contacting us (either on behalf of yourself, your business or another individual or organisation).

It is important that you read this privacy policy together with any other privacy policy or fair processing notice we may provide on specific occasions when we are collecting or processing personal data about you so that you are fully aware of how and why we are using your data. This privacy policy supplements the other notices and is not intended to override them.

It is important that the personal data we hold about you is accurate and current. Please keep us informed if your personal data changes during your relationship with us.

Our websites may include links to third-party websites, plug-ins and applications. Clicking on those links or enabling those connections may allow third parties to collect or share data about you. We do not control these third-party websites and are not responsible for their privacy statements. When you leave our websites, we encourage you to read the privacy policy of every website you visit.
Your personal data
Personal data that we collect about you is a piece of information about an individual from which that person can be identified. It does not include data where the identity has been removed (anonymous data) or data relating to a corporate entity.

We may collect, use, store and transfer different kinds of personal data about you:

1) identity data (first name, last name and title)
2) contact data (address, billing address, email address, telephone number)
3) financial data (bank account and payment card details)
4) transaction data (details about payments to and from you)
5) technical data (time zone settings and location, browser plug-in types and versions, operating system and other technology on the devices)
6) profile data (your purchase history, feedback username and password, account preferences and survey responses)
7) marketing and communications (your preferences in receiving marketing from us and our third parties and your communication preferences)
8) aggregated data (statistical or demographic data for any purpose)

We do not collect any of personal data (details about your race or ethnicity, religious or philosophical beliefs, sex life, sexual orientation, political opinions, trade union membership, criminal convictions or offences or information about your health, genetic or biometric data).

We need to collect personal data by law, or under the terms of a contract we have with you. If you fail to provide that data when requested, we may not be able to perform the contract we have or are trying to enter into contract with you (for example, to provide you with our software or services). In this case, we may have to cancel the service you have with us, but we will notify you if this is the case at the time.

We have put in place appropriate security measures to prevent your personal data from being accidentally lost, used or accessed in an unauthorised way, altered or disclosed. In addition, we limit access to your personal data to those employees, agents, contractors and other third parties who have a business need to know. They will only process your personal data on our instructions, and they are subject to a duty of confidentiality.

We have put in place procedures to deal with any suspected personal data breach and will notify you and any applicable regulator of a breach where we are legally required to do so.
GDPR
At RipTech, we aim to provide the best possible surf reports and content experience for our users. It’s also our goal to be open and transparent about the personal data we collect, how it’s used, with whom it’s shared, and how that data helps to make your experience better.

Our privacy policy reflects the increased transparency requirements of the EU General Data Protection Regulation (known as GDPR). While we’ve always strived to provide clear and simple information about the personal data we collect and how we use it.
